Cake Terms and Conditions

All sales made by PartyBakes are subject to the following terms and conditions.

Nothing contained within these terms and conditions affects your statutory rights as a consumer


The price for the order shall be stated on your order form. The customer is supplied with a copy of the terms and conditions of business at this point.

Placing an Order

When the customer has checked the order form and confirmed the cake details are correct a booking can be made. Placing a booking is agreement from the customer to accept the terms and conditions of business as stated in this document and found on the PartyBakes website.


All wedding cake orders require a non – refundable deposit of 50% of the total cost.

All other cake orders require a non – refundable deposit of 25% but not less than £25.00

Please note that all deposits are non – refundable and non – transferable

All deposits become due when the order has been placed.

All orders are deemed to have been accepted by PartyBakes only when the deposit has been paid.


Payments may be made by:

  • Cash
  • BAC’s payment

Final Payments

Final payments for orders must be made at least 10 days prior to delivery/collection.

Final payment for all wedding cakes must be made at least 28 days prior to delivery/collection

Non- Payments

In the event of non –payment, the order will not be completed or released, until payment is made in full.

Subsequent completion of the order will be subject to availability and cannot be guaranteed.

PartyBakes accepts no responsibility for any loss (howsoever caused) or non – delivery under these circumstances.

The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.

Alterations to Orders

Your cake is very important to us. Please take the time to check your copy of the order form carefully and let us know within three days if changes are needed. It is your responsibility to advise PartyBakes of any alterations to the original order.

PartyBakes reserves the right to increase a quoted fee in the event that the Customer requests a variation to the work agreed. Whilst every effort will be made to assist Customers, please note that late changes cannot always be guaranteed.

Cake Component Parts

From time to time some materials for our celebration cakes and wedding cakes may become obsolete or no longer available from our suppliers, for example, pre – manufactured items or ribbon colours. This is totally out of our control, though we will endeavour to re-design a cake to reflect as closely as possible the original design using replacement products. In all cases we will try to contact you to advise you of any such changes. However, PartyBakes, reserves the right to replace these with components of equal or better quality without consultation.


Your order may be collected at a pre-arranged time. A signature is required upon collection confirming that you have received your order in good condition and as specified.


Your order can be delivered (chargeable at 50p per mile for the round trip) All delivery times are subject to availability. If you have a specific delivery date and require delivery before a given time, please specify this when placing your order. We will do our best to accommodate your requirements. It is the Customer’s responsibility to ensure PartyBakes has been given the correct delivery information, and that someone is available to receive your cake. A signature will be required for the receipt of the order upon delivery.

If the recipient is not in, the order will be returned to PartyBakes who will contact you to arrange an alternative delivery time for which an additional charge will be payable by the customer. PartyBakes accepts no responsibility for any loss or consequential loss incurred by the Customer as a result, e.g. a wedding without a wedding cake.

Setting Up

Should you require your cake to be delivered, PartyBakes will deliver and set up your cake as agreed and will want to ensure it is displayed at its best. It is your responsibility to ensure that you have provided us with the set-up details and arrangements made with the venue for the location and display of your cake. PartyBakes cannot be held responsible for the location of the cake at the venue. Please ensure, therefore, that the cake location is level, stable and strong enough to hold the cake.

Please also remember that chocolate-covered cakes can melt in warm conditions such as inside a marquee on a hot summer’s day, or when set up in direct sunlight. Once the cake has been collected or delivered, set up and signed for, PartyBakes is unable to accept liability for any interference with or damage to the cake thereafter.

If the cake is to be delivered and set up by PartyBakes, a signature will be required from your venue management confirming the cake has been received and set up in good condition. A photograph of the cake will be taken prior to departure by us to verify that the cake has been set up and left in good condition.


Wedding cake or special order cancellations:

As your wedding cake and/or special order booking is reserved solely for you and certain components for your cake/s may be ordered months in advance, the following conditions are implemented when an order is cancelled:

  • 3 months from deliver date – 50% of the total cost will be payable
  • 0 to 1 months from delivery date – 100% of the total cost will be payable
  • Wedding cake/special order cancellations must be made in writing

Other cake order cancellations:

Full payment is required if cancellation is within 7 days of delivery date, prior to this a refund of any monies paid, less deposit, will be paid.


Please be aware that whilst your chosen cake may not be made with nuts or a nut product, egg, dairy wheat or gluten, It will be prepared in a kitchen where nut products, eggs, diary, wheat and gluten are heavily used. Whilst every effort is made to separate raw materials PartyBakes must state that raw materials used in your cake may not be free from nuts, eggs dairy, wheat or gluten.

Catering Terms and Conditions


‘The Company` means “PartyBakes” and ` The client’ means any person or company contracting with The Company.

The Quote

Following our discussions the company will provide you with an individual written quotation.

It will remain valid until the date of the client’s event.

Should the event brief alter, it will be necessary to review and re-issue the quotation.

The Payment

The company`s services will be delivered under the terms and conditions set out below.

A 25% deposit will be paid at the time of booking. Payments can be made via cheques, payable to: PartyBakes, or online BACS payments

Payment of the deposit will be deemed as acknowledgment and acceptance by the client to adhere to the company’s terms and conditions.

Confirmation of the client’s event will take place once the deposit has been submitted.

Failure by the client to submit the deposit may cause the company to cancel the event.

When the deposit (or full payment) is submitted, a copy of the Terms and Conditions will be supplied to the client by the company.

Payment Terms

As many costs are incurred on the client’s behalf prior to the event date, the company has the following payment terms which the client must adhere to.

Failure to adhere to these payment terms will affect the delivery or booking of given event.

A deposit of 25% of the total quotation is required immediately to confirm the event.

A deposit of 25% is also payable on booking for the hire of food presentation equipment.

Full payment of all known costs is payable 5 working days before the day of the event.

Cheques must be payable to: PartyBakes, or online BACS payments

All charges unpaid after the respective final date for payment shall carry interest on the amount outstanding at a rate of 10% for every calendar month until pain full.


In the instance that you need to cancel your event, the following conditions will apply:

All cancellations must be made by telephone, in the first instance and confirmed in writing or by email.

The Event will only be cancelled when the client is in receipt of a Cancellation Acceptance from The Company, which will either be a written letter or an email from The Company.

In the event of a cancellation the company and client agree to operate within the following terms:

Cancellation 2 weeks before the event date

25% of total quotation, plus any costs incurred on the clients behalf from the company’s suppliers

Cancellation 1 week before the event date

50% of total quotation, plus any costs incurred on the clients behalf from the company’s suppliers

Cancellation 5 days or less before the event date

100% of total quotation, plus any costs incurred on the clients behalf from the company’s suppliers

Where circumstances beyond The Company`s control prevent us from fulfilling any obligations,

The Company will, by notice in writing to The Client, terminate the Contract and return to The Client any balance of payment

on Account, in respect of the proposed provision of the Services.


The Company follows strict HACCP guidelines for all food production, handling, storage and distribution and dealings with our clients and their guests. Our policy, based on these guidelines, restricts the service of foodstuffs, to a maximum of four hours after being removed from refrigeration.

The Company advice that all food must be consumed after three hours of initial serving, therefore any food consumed after three

hours or more hours of it first being served is at The Clients discretion and therefore becomes their responsibility.

Where the Company use The Clients kitchen facilities, they will be thoroughly reviewed prior to the Event but if they deemed to be unusable on the Event Date, then The Company will accept no liability for cancellation of the Event.


The Company does not accept liability and shall not be liable for non-completion of any event or for any delays arising as a result of:

Strikes, riots or lock outs affecting any trade with which The Company is concerned, exceptionally adverse weather conditions.

Loss, damage or cancellation due to fires, floods of any other cause beyond its reasonable control.

The liability of the Company in respect of all claims arising under any contract should be limited to the amounts of the price or charges payable to The Company under such contracts.

The Company shall not be liable under any circumstances for any indirect cause of consequential loss or damage whatsoever to property belonging to the Company or Hired, if accidentally, wilfully or negligently damaged or stolen at any event, the replacement cost is payable by the Client within 7 days from the date of the event.

Accidental damage at the event should be covered by the Clients own insurance and no claim will be accepted by the Company or the Hire Company.
